Terms of Service

These Terms of Service (the "Terms") govern your use of usa.beltrax.peand the services Beltrax offers through it. By using the site or hiring our services, you agree to these Terms. If you don't agree, please don't use the site.

1. Who we are

Beltrax is the trade name of GRUPO BYP SAC, a company registered in Peru (RUC 20606230762) with offices at Av. Grau 629, Barranco, Lima, Peru. Contact: contacto@beltrax.pe.

2. Using the website

You may use this site to learn about our services and contact us. You agree not to:

• Use it for unlawful purposes or in a way that infringes the rights of others.
• Try to breach the security of the site, its systems or its databases.
• Copy, reproduce or modify its content for commercial purposes without our written permission.
• Send spam, malicious software or false information through our forms.

When you send us information to request a service, you confirm that it is accurate and up to date.

3. Information and prices on the site

We work to keep the information on this site accurate, but it is for general reference only. Prices are shown in US dollars. The scope, price, timeline and payment terms of every project are set out in the written proposal you approve, which prevails over the information on this site and over these Terms if they conflict.

4. Hiring our services

• Proposal. Every project starts with a call and a formal written proposal. The project is confirmed when you approve it and make the first payment.
• Payments. Unless your proposal says otherwise, projects are paid in two parts: 50% when the project is confirmed, before work begins, and 50% on delivery, once the agreed revision period is complete. You can pay by bank transfer or credit card, and we invoice in US dollars.
• Delivery. The 5-business-day timeline starts once you approve the brief and make the first payment, and it depends on receiving the materials we need from you (logo, copy and images) and your feedback on time.
• Revisions. Each package includes the rounds of revisions stated in it. Additional changes or new features are quoted separately.
• Hosting and domain. Included for the first year in every website package. Terms after the first year are set out in your proposal.
• Support. Every package includes 30 days of post-launch support. After that, changes are billed by the hour at a preferred rate.
• Automation service. The monthly fee covers the platform, support and ongoing optimization. Messaging costs depend on your volume. Billing and cancellation terms are set out in your proposal.
• Late payments.If a payment isn't made on the agreed date, we may pause work or delivery until it is settled. We will always let you know before pausing any work in progress.
• Cancellations and refunds.If you cancel before production starts, we'll consider a full or partial refund of the first payment based on the work already done (for example, planning or discovery calls). Once production or development has started, the first payment is non-refundable, since it covers team time, resources and providers already committed.

5. Your materials

You are responsible for having the rights to the materials you give us (logos, copy, images and others) and you allow us to use them to carry out your project.

6. Intellectual property

The content of this site (copy, images, designs, the Beltrax name and logo, code and other materials) belongs to GRUPO BYP SAC or to clients and third parties who authorized its use. The rights to the work we deliver to each client are governed by that client's proposal or contract. With your authorization, we may show your project in our portfolio.

7. Text messages (SMS)

If you opt in on one of our forms, you'll receive text messages from Beltrax about your inquiry, such as appointment confirmations, reminders and follow-ups. Message frequency varies. Message and data rates may apply. Reply STOPto cancel at any time; you'll get one message confirming you've been unsubscribed. Reply HELP for help or write to contacto@beltrax.pe. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of any purchase. See our Privacy Policy to learn how we handle your information.

8. Third-party links and services

This site may link to other websites and use third-party tools, such as our booking calendar. We don't control them and aren't responsible for their content or practices.

9. Disclaimer and limitation of liability

The site is provided "as is". We work to keep it secure and available, but we can't guarantee it will be free of errors, interruptions or harmful components. To the extent permitted by law, Beltrax is not liable for indirect, incidental or consequential damages, or for lost profits, arising from the use of the site or our services, and our total liability for any claim related to a project is limited to the amount you paid us for that project. Nothing in these Terms limits any liability that cannot be limited by law.

10. Privacy and cookies

We handle your information as described in our Privacy Policy and our Cookie Policy.

11. Changes to these Terms

We may update these Terms. We'll post the new version on this page with its update date, and using the site after that means you accept the changes. Proposals you have already approved keep their own terms.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Peru. If a dispute arises, we'll first try to solve it in good faith: write to us and we'll answer. If we can't, it will be resolved by the courts of Lima, Peru, unless the consumer protection laws of the place where you live require otherwise.
